Welcome to LovelyKey. These Terms of Use ("Terms") govern your access to and use of the LovelyKey mobile application and related services (the "Service"). By downloading, installing, or using LovelyKey, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility & Account

Age Requirement:

You must be at least 13 years old (or the minimum legal age in your country, e.g. 16 in the EU) to use LovelyKey.

Account Registration:

You may sign up with an email/password or via a third-party provider. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

Parental Consent:

If you are under 18, you must have your parent or guardian's permission to use the Service.

2. License Grant

LovelyKey Inc. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the app solely for personal, non-commercial purposes.

You may not copy, distribute, reverse engineer, or create derivative works except as permitted by law.

3. Free Trial & Subscription

Free Trial:

New users may receive a limited free trial (e.g., three AI-generated replies).

Subscriptions:

We offer weekly, monthly, or annual plans. Subscriptions renew automatically unless canceled at least 24 hours before the end of the billing period.

Cancellation:

You may manage or cancel auto-renewal through your App Store / Google Play account settings.

Refunds:

Payments are non-refundable except as required by law or the App Store / Google Play refund policies.

4. Use of Service

AI Processing:

By submitting text for AI processing, you authorize us to transmit it to third-party AI providers.

Permitted Use:

You agree not to use the Service to:

Engage in unlawful, harmful, or abusive behavior.
Submit disallowed content (e.g. hate speech, explicit sexual content, harassment, personal data of others without consent).
Infringe intellectual property or privacy rights.

Content Ownership:

You retain ownership of the text and content you input.
By using the Service, you grant us a limited license to use anonymized and aggregated data for service improvement, research, and analytics.

5. Privacy

Your use of the Service is also governed by our Privacy Policy. By using LovelyKey, you consent to our collection, use, and sharing of personal information as described in that Policy.

6. App Store & Google Play Provisions

These Terms are between you and LovelyKey Inc., not Apple or Google.

Apple Inc. and Google LLC are third-party beneficiaries of this agreement. Upon your acceptance of these Terms, Apple and Google have the right to enforce them against you.

7. Disclaimers & Limitation of Liability

No Warranties:

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted, secure, or error-free operation.

Limitation of Liability:

To the maximum extent permitted by law:

Our total liability for claims related to the Service shall not exceed the amount you paid to LovelyKey in the 12 months prior to the claim.
We are not liable for indirect, incidental, or consequential damages.

8. Indemnification

You agree to indemnify and hold harmless LovelyKey Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Service.

9. Termination

We may suspend or terminate your access if you violate these Terms or as required by law.

Upon termination, your license to use the Service ends immediately.

We may delete your account and data in accordance with our Privacy Policy.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-law rules.

Any dispute shall be resolved by binding arbitration in San Francisco, California, under the rules of the American Arbitration Association (AAA), unless you are entitled under applicable law to bring the claim in your local courts.

Consumers in the EU, UK, Japan, and other jurisdictions retain any mandatory rights under local law.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
